Agreement and Terms

Ownership: RCARRIGAN MEDIA, LLC retains all copyright, ownership, and intellectual property rights to all images, videos, floor plans, and media created during the session (collectively, the “Work”), pursuant to the United States Copyright Act.
Grant of License: Upon receipt of full payment, RCARRIGAN MEDIA, LLC grants the Client a non-exclusive, non-transferable, limited license to use the Work.
Permitted Usage: This license allows the Client to use the Work for the sole purpose of marketing the Property for sale or lease. This includes the Multiple Listing Service (MLS), real estate websites (Zillow, Realtor.com, etc.), social media, and print flyers.
Expiration: This license expires once the Property has been sold, the listing expires, or the Client is no longer the listing agent, whichever occurs first.
Third-Party Restriction: Client may not sell, license, or give the Work to any third party (including, but not limited to, home builders, stagers, interior designers, architects, or other real estate agents) without the express written permission of RCARRIGAN MEDIA, LLC.

Ready-to-Shoot: The Client is responsible for ensuring the Property is “photo-ready” prior to the scheduled shoot time.
As-Is Condition: If the Property is not ready (e.g., messy, ongoing construction, pets present), the Photographer will shoot the property in “as-is” condition or, at the Photographer’s discretion, a cancellation/reschedule fee may apply. The Photographer is not responsible for cleaning, moving furniture, or staging.
Aerial Limitations: Aerial services are subject to FAA regulations and weather conditions. If weather or airspace restrictions prevent flight, this portion of the service will be rescheduled or refunded at the Photographer’s discretion.

Payment: Payment is due in full [Option: Upon Booking / Prior to Delivery of Images]. Images will not be released until payment is received.
Cancellation: Cancellations made less than 24 hours before the scheduled appointment are subject to a cancellation fee of $50.
Rescheduling: If the shoot is rescheduled due to inclement weather, no fee will be charged, provided the decision is made mutually.

Timeframe: Standard delivery time for photos is 1 business day from the completion of the shoot. Video and Floor Plans may require additional processing time.
Format: Media will be delivered via digital download link in a resolution suitable for MLS and web use.

Indemnification: Client agrees to indemnify and hold harmless RCARRIGAN MEDIA, LLC against any claims, liability, damage, cost, or expense arising out of any injury to any person or damage to any property occurring during the performance of services, unless caused by the gross negligence of the Photographer.
Floor Plan Accuracy: Floor plans are for illustrative purposes only. Measurements are approximate and should not be relied upon for valuation or renovation purposes. RCARRIGAN MEDIA, LLC accepts no liability for errors in measurements.

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia. Any legal action or proceeding arising under this Agreement will be brought exclusively in the federal or state courts located in Catoosa County, Georgia.
